Last year, a group of St. Louis citizens filed suit asserting that the Missouri Land Assemblage Tax credit law enacted by the Missouri Legislature was unconstitutional. On March 31, 2010, Judge Cole ruled, with prejudice, that the plaintiffs' claim lacked merit and that the law was enacted on solid constitutional grounds. In my opinion, the cloud surrounding these Missouri tax credits has been removed. While an appeal is likely, the plaintiffs will most likely be required to post a substantial bond in order to pursue an appeal.
